Web Visitors
Like most web site operators, COVERT NINE collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. COVERT NINE’s purpose in collecting non-personally identifying information is to better understand how COVERT NINE’s visitors use its web site. From time to time, COVERT NINE may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its web site.
COVERT NINE also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users and for users leaving comments on the sites we provide Services for. COVERT NINE only discloses logged in user and commenter IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below, except that commenter IP addresses and email addresses are visible and disclosed to the administrators of the site where the comment was left.

We do not knowingly collect personal information from children under the age of thirteen. Gathering Personally Identifiable Information
Certain visitors to COVERT NINE’s web sites choose to interact with COVERT NINE in ways that require COVERT NINE to gather personally-identifying information. The amount and type of information that COVERT NINE gathers depends on the nature of the interaction. For example, we ask visitors who sign up for a site at COVERT NINE.com to provide a username and email address. Those who engage in transactions with COVERT NINE – by purchasing hosting service, for example – are asked to provide additional information, including as necessary the personal and financial information required to process those transactions. In each case, COVERT NINE collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with COVERT NINE. COVERT NINE does not disclose personally-identifying information except to effectively deliver its services (for example, disclosing payment information to a third party payment processor to process credit card payments ) or other than as described below. And visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain web site-related activities. Please note that the privacy of any personally identifying information disclosed to any third party pursuant to these terms may be subject to such third party’s privacy policies. We may collect various types of personal and non-personal information about visitors to our Sites either directly or through integrated third-party applications (collectively “Consumer Information”), including:

- Contact Information you submit for someone else;
- Payment information such as credit card information, financial account information, billing address, signature, and gift card information) (“Payment Information”);

We collect Consumer Information when you send us an email, use the Online Ordering Site, register for a mailing list, create an account with us, or place an order through our Sites using the Online Ordering Site. We also collect information using Cookies, as described below. By providing your mobile phone number, you expressly consent to receiving text messages from us regarding order status and updates. By placing an order through our Sites or the Online Ordering Site, you expressly consent to receiving text messages or push notifications about your order. Standard text message rates may apply.
Use of Cookies
When you visit our Sites, we may store information on your computer in the form of a “Cookie,” which will help us in several ways. For example, Cookies allow us to tailor our Sites to better match your interests and preferences. With most Internet browsers, you can erase Cookies from your computer hard drive, block all Cookies, or receive a warning before a Cookie is stored. Please be aware, however, that without Cookies, you may not be able to use all of the features of our Sites. If you use site features operated by third-party vendors (discussed below), such as when you use the Online Ordering Site, payments via our third party payment processors, and third party social networking services (such as Facebook, Twitter, Instagram, etc.), we may receive information you have made available to those vendors or services, including the geographic location of your mobile device, device type, IP address, and other information about you (such as your name, email address, gender, physical location, social media profile URL, personal website URL, biographical information, birthdate, photo, list of devices, education history, work history, hometown, interests, current city, political views, favorite athlete and teams, relationship status and information, religion, name of significant other, and certain security settings information) and your contacts on those services. Some of the social networking services allow you to push content from our Sites to your contacts or to pull information about your contacts so you can connect with them on our Sites. Some of these services also will facilitate your registration for our Sites or enhance or personalize your experience on our Sites. You should make sure you understand the information your third-party social networking services may make available to our Sites. We may use and disclose the Consumer Information we receive on our Sites through third-party vendors and social networking services as described in this Privacy Policy.
How We Share Information
We may share your Personal Information with companies that we partner with (“Third Party Providers”) to obtain services and provide a positive customer experience. Some examples of services that Third Party Providers provide are online order fulfillment, creation, administration, and hosting of the Sites, data analysis, credit card processing, credit card risk and fraud analysis, marketing efforts and analysis, and obtaining ratings and feedback on your experiences. We may also share information we obtain from you with our affiliates.
In addition, we may disclose information about you when required to do so by law, regulation or legal process (such as court order or subpoena), in response to requests by government agencies or law enforcement personnel, in connection with an investigation into suspected criminal activity, or when we believe disclosure is necessary to prevent harm. Personal Information, once de-identified, aggregated, and/or no longer able to specifically identify you, may be shared with third parties for marketing, advertising, analytics, and other purposes, without further obligation to you, so long as not prohibited by applicable law.
How We Protect the Information you Provide
We do not store your information directly. We use third party partners that implement administrative, technical, and physical safeguards designed to protect the Personal Information and Payment Information you provide from accidental, unauthorized or unlawful access, alteration, disclosure, use, destruction or loss. All Personal and non-Personal Information, including Payment Information collected by us is stored in a secure environment, in some instances by third parties (for example, in the case of payment information stored by our third party payment processors) and pursuant to applicable law and generally accepted industry standard levels of security.
Links to Other Sites and Third Party Terms
Our Sites may contain links to other websites that are operated by companies not affiliated with us. Likewise, our Sites may contain links or functionality provided by Third Party Providers (foe example, our online ordering platform and payment processing providers). We are not responsible for the content or privacy practices on any of these non-Fiesta Mexicana Sites. However, any usage or integration of such Third Party Provider platforms or functions does not change our obligations to you as set forth in this Privacy Policy.
Business Transfers
If COVERT NINE, or substantially all of its assets, were acquired, or in the unlikely event that COVERT NINE goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of COVERT NINE may continue to use your personal information as set forth in this policy.
Comments
Comments and other content submitted to our Services are not saved on our servers unless they were marked as false positives, in which case we store them long enough to use them to improve the Services to avoid future false positives.
What Are Your Options?
You are not under any obligation to provide us with your Consumer Information. However, if you choose not to provide us with Personal and/or non-Personal Information, we may not be able to provide you with certain services or use of our Sites. For example, when you place an online order through our Sites or the Online Ordering Site, you must provide us with personal information such as your name, email address and telephone number as well as financial information including credit card number and billing address.
